Terms & Conditions

1. Booking & Confirmation

A booking is confirmed only when:

• We have issued a written confirmation, and
• The required deposit has been received.

We reserve the right to decline bookings at our discretion.

2. Payment Terms

• A non-refundable deposit may be required to secure your date.
• The remaining balance must be paid before the event date unless otherwise agreed in writing.
• Failure to pay the balance may result in cancellation of services.

All prices are quoted in GBP.

3. Cancellations

Client Cancellation

• Deposits are non-refundable.
• If cancellation occurs within 14 days of the event, full payment may still be required.
• Rescheduling may be offered at our discretion, subject to availability.

Our Cancellation

In the unlikely event that we must cancel due to circumstances beyond our control, we will provide a full refund of payments received. We are not liable for additional losses or costs incurred.

4. Event Requirements

The client is responsible for:

• Providing adequate space for setup and operation.
• Ensuring safe access to the venue.
• Providing a suitable power supply (if required).
• Ensuring the booth location is weather-protected unless agreed otherwise.

We reserve the right to refuse operation if conditions are unsafe.

5. Equipment Responsibility

The client is responsible for ensuring guests treat the equipment appropriately. Any damage caused by misuse, negligence, or intentional acts may be charged to the client. We retain full ownership of all equipment at all times.

6. Operational Limitations

While we take all reasonable steps to ensure reliable service:

• We are not responsible for interruptions caused by power failures, venue restrictions, or force majeure events.
• Minor technical interruptions may occur.
• We are not liable for loss of digital files due to circumstances beyond our reasonable control.

7. Image Usage

Unless agreed otherwise in writing, we reserve the right to use photographs for promotional purposes, including:

• Website
• Social media
• Marketing materials

If you require full privacy, you must request it in writing prior to the event.

8. Liability

Capture Collective Ltd shall not be liable for:

• Indirect or consequential loss
• Loss of profit
• Venue-related incidents
• Injury caused by the misuse of equipment

Our total liability shall not exceed the amount paid for the services.

9. Force Majeure

We are not liable for failure to perform obligations due to events beyond our reasonable control, including but not limited to:

• Severe weather
• Government restrictions
• Venue closure
• Acts of God
• Strikes or civil unrest

10. Governing Law

These Terms & Conditions are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
